Terms of Service

1. Acceptance of Terms

By accessing or using Propease ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users including landlords, property managers, tenants, and applicants.

2. Description of Service

Propease is a rental management platform that helps landlords manage property listings, receive tenant applications, perform AI-assisted screening and reference checks, generate lease agreements, and track leases. The Service includes a web application, APIs, and related tools.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to create an account.
  • One person may not maintain more than one free account.
  • You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Submit false, misleading, or fraudulent property listings or applications.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated tools to scrape or extract data from the platform.
  • Discriminate against applicants in violation of human rights legislation.

5. Subscription & Payments

  • Propease offers free and paid plans. Paid features are available through monthly or annual subscriptions.
  • Payments are processed securely through Stripe. By subscribing, you authorize recurring charges.
  • You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact support for refund requests.
  • We reserve the right to change pricing with 30 days' written notice.

6. AI Features & Screening

Propease uses artificial intelligence to assist with application screening, document verification, and reference checks. These AI tools provide recommendations only and do not constitute legal advice. Landlords remain solely responsible for all tenancy decisions and must comply with applicable human rights and tenancy legislation.

7. Lease Agreements & E-Signatures

Propease facilitates the generation and electronic signing of lease agreements. While we strive for accuracy, it is your responsibility to review all generated documents before sending them for signature. Propease does not provide legal advice and is not liable for errors in lease content.

8. Intellectual Property

The Service, including its design, logos, text, and code, is owned by Propease and protected by intellectual property laws. You retain ownership of content you upload (property photos, documents, etc.) but grant us a license to use it to provide the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Propease shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure at all times.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Data retention after termination is governed by our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on the platform at least 30 days before they take effect. Continued use after changes constitutes acceptance.
